US Judge Orders Release of Kilmar Abrego Garcia from ICE Detention

A court has ordered the prompt release of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing detainment lacks legal authority.

"Since his release after erroneous detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her order.

The case originates in a erroneous removal to El Salvador in March, which US authorities later acknowledged was an error. After his return to the United States to face human smuggling allegations, he was detained in federal detention.

In her decision, the court noted that the authorities lacks a valid removal order, which prevents them from removing Mr. Abrego Garcia "at this time."

Context of the Case

The court proceedings involve conflicting claims. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 gang, he vehemently denies this allegation.

He has also entered a not guilty plea to the conspiracy charges, which are part of a separate criminal case in the state of Tennessee.

Conditions of Release

The court, who was overseeing his petition to removal in a federal court, determined that he must now comply with the conditions of his bond from custody in Tennessee. This decision shifts his monitoring to the Tennessee court.
