The ex-lawyer for the former president has resigned as the chief federal prosecutor in the state. This decision was prompted by a court battle that invalidated her legal standing to hold the office.
Attorney General's Statement
The head of the Justice Department, Pam Bondi, accepted the prosecutor's departure on Monday. Bondi stated that the appeals court finding made it impossible for Habba to lead the department effectively.
"Let no one confuse compliance for surrender," Habba stated. "My fight will now extend throughout the country."
Court Ruling
Her resignation follows closely on a federal appellate panel ruled that she had been acting without proper authority as the federal prosecutor. This ruling is likely to affect numerous legal proceedings in the Garden State.
The judicial panel said that a acting appointment that bypassed the advice and consent of the Senate ran afoul of the statute on vacant positions.

The 41-year-old attorney, originally became part of Donald Trump's lawyers in 2021. She later defended her client in his hush-money trial in 2024, when he was conviction on 34 counts of document fraud.
Earlier, assuming the federal prosecutor position, Trump had stated he was appointing her as his White House advisor if re-elected, calling Habba as deeply loyal and a dedicated fighter for justice.
