Andrej Babiš, the self-proclaimed tycoon who won last month's Czech election, has refused to sell his vast business interests, while asserting he will resolve a conflict of interest that might prevent him from assuming the position of head of government.

Position on Business Holdings

Babiš, whose political movement came first in the autumn election but lacked a parliamentary majority, stated in a online statement that he will not sell his Agrofert group, which operates in farming, food production, and chemicals.

“I have consistently stated I will not sell Agrofert. I have repeatedly said I will resolve the conflict of interest in accordance with Czech and EU regulations,” Babiš remarked. “This is different from selling a pastry in a bakeshop.”

Head of State's Demand

The Czech president, Petr Pavel, stated that the elderly political figure must publicly explain how he will remove conflicts of interest arising from his corporate dealings before being appointed prime minister.

The Czech constitution “clearly mandates the president to take into account the possible emergence of a ethical issue and the ways to address it” when selecting government ministers, Pavel's office explained.

The head of state “expects clarity in what precise manner Andrej Babiš will fulfil his constitutional and legal obligations”, the announcement added, stating that Pavel was ready to designate Babiš as premier “without delay” once the issue was resolved.

Business Operations and Legal Issues

Babiš's numerous companies, mostly under the Agrofert umbrella, operate in the nation and other regional countries, receiving millions of euros in national and EU farming and other grants, as well as public contracts.

Under Czech law, government ministers cannot receiving public aid or agreements. The anti-corruption watchdog Transparency International has stated that to prevent a conflict of interest, Babiš must either divest, decline public contracts, or stay out of public office.

Previous Term and Present Plans

Babiš said he would “follow the laws” if selected as prime minister, but did not want to detail how in beforehand because the issue was “an extremely sensitive and personal matter for me, and journalists will invariably criticise me regardless”.

During his initial tenure as premier, from 2017 to 2021, Babiš encountered multiple legal battles and an European inquiry over potential ethical issues. He placed his holdings into fiduciary arrangements, while keeping some influence over them.

A judicial body and the European Commission both determined that this was insufficient. Babiš stated recently that he was once more the exclusive proprietor of Agrofert and maintained he was “implementing measures” to avoid a conflict of interest, but declined to reveal specifics.

Governing Agreement and International Implications

The billionaire populist has signed a governing pact with two minor right-leaning groups, the ultra-conservative, Russia-friendly SPD, which has called for a referendum on leaving the EU, and the Motorists for Themselves, which has primarily opposed the EU’s environmental policy.

The new government, if confirmed, is likely to bolster the populist movement in central and eastern Europe and could strain backing from Western nations for Ukraine – although Babiš has called Ukraine’s leader, Volodymyr Zelenskyy, to assure him of the nation's backing.

Pavel, who as head of state has a role for foreign policy, also demanded that the coalition’s programme add a declaration on the government’s position on the conflict in Ukraine, including a commitment to fulfilling alliance duties.

The president has previously said he would not approve any ministerial nominees who might doubt the Czech Republic’s international alliances, a condition that the ultra-conservative party has indicated it will meet by proposing non-partisan experts.
